Terms and Conditions

General Provisions


These terms and conditions define the mutual rights, obligations, and responsibilities of the Buyer (hereinafter referred to as the Buyer) and Tvarkoi, MB (hereinafter referred to as the Seller) when the Buyer purchases goods in the online store www.drinkarba.com.


1.1. These online store rules (hereinafter referred to as the Rules) are a binding legal document for both the Buyer and the Seller. They define the rights and obligations of the Parties, the conditions and procedures for purchasing goods, payment, delivery, returns, and other terms related to buying and selling goods in the online store.


1.2. Under these Rules, a Buyer is a person who purchases goods in the online store. The following persons may shop in the online store:
1.2.1. A legally capable natural person, i.e., a person of legal age whose legal capacity has not been restricted by a court;
1.2.2. A legal entity.


1.3. By registering or placing an order, the Buyer unconditionally confirms that they have the right to purchase goods in the online store.
 

1.4. The Seller reserves the right to amend, modify, or supplement these Rules at any time. The Buyer is informed of changes to the Rules on the online store’s website. Amendments take effect from the moment of publication and apply to all transactions concluded after publication. Therefore, the Buyer is advised to review the Rules before each purchase.
 

1.5. The Seller shall not be held liable if the Buyer has partially or fully failed to familiarize themselves with the Rules, even though such an opportunity was provided.


A purchase is considered concluded when the Buyer, after forming a shopping cart in the online store, providing all required information, and paying (or choosing to pay) the specified amount to the Seller, receives an order (purchase) confirmation sent to the Buyer’s indicated email address. By submitting an order, the Buyer is deemed to have read and unconditionally agreed to these Rules.

Ordering Goods and Contract Conclusion


The Buyer may shop in the online store 24 hours a day, 7 days a week.
Prices of goods in the online store and in the order are indicated in euros, including VAT.
Delivery costs are indicated separately when forming the shopping cart.

 

Buyer’s Rights and Obligations
 

In accordance with these Rules and the laws of the Republic of Lithuania, the Buyer has the right to purchase goods in the online store.
If the data provided in the Buyer’s account changes, the Buyer must update it.
The Buyer has the right to return or exchange goods under the conditions specified in these Rules.
If the Buyer attempts to harm the operation or stable functioning of the online store, the Seller may restrict, suspend, or terminate the Buyer’s access to the online store without prior notice.

 

Seller’s Rights and Obligations
 

The Seller has the right to temporarily or permanently suspend the operation of the online store without prior notice.
To provide conditions enabling the Buyer to properly use the services of the online store.
To organize the delivery of the goods ordered by the Buyer to the address specified by the Buyer.
If, due to significant circumstances, the Seller is unable to deliver the ordered goods, the Seller undertakes to offer the Buyer an аналогous product or change the delivery deadline; if the Buyer refuses, the Seller shall refund the paid amount within 3 business days.
The Seller has the right, without prior notice, to cancel the Buyer’s order after 3 business days if the Buyer fails to pay within the specified time or does not provide additional information necessary to properly fulfill the order.
The Seller has the right to delete (block) the Buyer’s account if incomplete, false, or misleading information is provided.

 

Payment Procedure and Terms
 

The Buyer pays for goods using one of the payment methods selected during the order process.
Order processing and delivery time calculation begin only after the Seller sends a purchase confirmation to the Buyer’s email address.
Payments can be made using the electronic banking services of Swedbank, SEB, Luminor, Citadele, and Artea. Payments are accepted in Euros. Payments are processed via the MakeCommerce.lt payment platform

 

Delivery of Goods
 

Goods are delivered throughout Lithuania to parcel lockers via courier services.
Delivery costs are specified in the Buyer’s order.
Delivery timeframes are indicated in the order. The Buyer agrees that, in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to immediately contact the Buyer and agree on delivery conditions.
The Seller shall not be liable for failure to meet delivery deadlines if the goods are not delivered or are delivered late due to the Buyer’s fault or circumstances beyond the Seller’s control.

 

Return or Exchange of Goods
 

If a food product of inadequate quality is sold to the Buyer before the expiration date, the Buyer has the right, at their discretion, to:
1.1. request replacement with the same product of proper quality;
1.2. request a corresponding price reduction;
1.3. return the product to the Seller and demand a refund of the amount paid.
These rights may also be exercised if the Buyer is sold a product whose expiration date has already passed.
Food products of inadequate quality are exchanged or returned at the place of purchase or another location indicated by the Seller that is convenient for the Buyer. The Buyer must submit a written request together with the product. The request must specify the defects of the product and the Buyer’s chosen claim under these Rules. A cash register receipt or another document confirming the purchase from the Seller must be attached.
If the Buyer does not provide a cash register receipt or another duly issued document confirming the purchase, the product may be exchanged or other claims fulfilled only with the Seller’s consent.
The Buyer (a natural person) has the right to withdraw from an online contract without giving a reason (return a product of proper quality) within 14 days (Civil Code Article 6.228(10) of the Republic of Lithuania), except for the exceptions provided in paragraph 2 of this Article. The paid amount, including delivery costs paid by the Buyer, shall be refunded within 14 days from the day the Buyer notifies the Seller of the withdrawal. However, the Seller may withhold the refund until the goods are received or proof of dispatch is provided. Return shipping costs are borne by the Buyer.

Final Provisions


All disputes arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
Amendments or supplements to these Rules take effect from the date of their publication in the online store system.
If, after amendments, the Buyer continues to use the online store, it is deemed that the Buyer agrees with the updated Rules.
Consumer disputes out of court are handled by the State Consumer Rights Protection Authority, address: Goštauto g. 12, Vilnius, www.vvtat.lt.
Consumers may submit requests or complaints via the EU Online Dispute Resolution platform: http://ec.europa.eu/odr/.
These Rules do not limit the Buyer’s rights established by the laws of the Republic of Lithuania, including rights related to the purchase of goods or services of inadequate quality.
